Partnership visas

• I am an Australian citizen and my same sex partner is from Poland. We would like to come and settle in the UK and possibly get married. I know there is a visa for same sex partnership but we are concerned as my partner is not living in the UK at present. We also don't have documents in both names as we have been travelling for over 5 years. Would I be granted a visa without these requirements? Would you please help us.
