Applying for SET(M)

  • I am marrying my fiancé, a Canadian national, under special licence from the Archbishop of Canterbury in an Anglican Church on the 6th of September 2008. My fiancé has been living and working in the United Kingdom since March 2006 under a 4 year ancestry visa. During this time we have been living together as partners.

    I am seeking advice with respect to the following issues -

    Following our marriage we intend to remain in the United Kingdom, could you please advise what steps we need to take to facilitate this?

    Will the ancestry visa still be valid or will my (new) wife need a permission of stay to be issued in the shape of a spousal visa?

    At what point can my wife apply for indefinite leave to remain (ILR) or permanent residency in the UK?

    Does the time we have already spent together in the UK mean we can apply for ILR early or do we have to be married for two years?
